General Terms and Conditions

Marmotzet, Adilia Faivre (the “Mountain Leader”), offers organised and guided outdoor activities for any interested individual (the “Participant”). The following general terms and conditions form an integral part of the contract between the Mountain Leader and the Participant.

Registration

The contractual basis is the Participant’s registration, whether written or verbal, via the website, email or phone. These general terms and conditions apply from that moment. By registering, the Participant confirms having read, understood and accepted these terms.

The registration is considered complete once payment has been received. The Mountain Leader reserves the right to validate or refuse a registration and may cancel it at any time before the activity begins, without having to provide a reason.

Prices and payment terms

The recommended rates by ASAM-SWL are CHF 500 for a full day and CHF 380 for less than 4 hours. The Mountain Leader reserves the right to apply different rates depending on the services provided, the size or the composition of the group.

The price includes the organisation and guiding services of the Mountain Leader during the activity.

Unless otherwise stated, the price does not include accommodation, transport, meals, drinks, personal expenses or equipment (including snowshoes or avalanche safety equipment).

The full amount must be paid at the time of registration. Payments can be made by bank transfer or TWINT. Cash payments are not accepted.

Cancellation conditions

If the Participant cancels their registration, specific cancellation conditions may apply if stated. Otherwise, the following applies:

- Cancellation up to 7 days before the activity: 0% of the total amount is due

- Cancellation from 7 days before the activity: 50% is due

- Cancellation from 2 days before the activity: 100% is due

Outdoor activities depend on external factors such as weather and natural conditions. The Mountain Leader reserves the right to modify the itinerary before or during the activity, or to cancel it for safety, health or comfort reasons. The price remains unchanged in case of itinerary modifications.

In case of cancellation by the Mountain Leader, an alternative date or a full refund will be offered.

Third-party services

In some cases, the Mountain Leader may make reservations (accommodation, transport) on behalf of the participants. The related costs may be invoiced separately or advanced by the Mountain Leader on behalf of the Participant.

These services are provided by third-party providers and are subject to their own terms and conditions, particularly regarding cancellation and refunds.

The Mountain Leader acts solely as an intermediary and cannot be held responsible for any changes, cancellations or conditions related to these services.

These services may be non-refundable.

Liability and insurance

The organisation and supervision are ensured by the Mountain Leader, who holds the required qualifications and is covered by professional liability insurance.

The Participant must be in good health and physical condition. Any medical condition (e.g. diabetes, epilepsy, heart conditions, allergies, asthma) or concerns (e.g. fear of heights) must be communicated at the time of registration. The Participant is responsible for bringing any necessary medication.

The Participant acknowledges the inherent risks of mountain activities and participates at their own responsibility. They are responsible for their personal belongings, their behaviour and for following the instructions given by the Mountain Leader.

The Participant is responsible for bringing appropriate equipment. The Mountain Leader reserves the right to refuse participation if the equipment is inadequate.

The Participant is responsible for their own health, accident and repatriation insurance, including mountain rescue (e.g. helicopter rescue). Personal liability insurance is also required. Cancellation insurance is strongly recommended.

Use of photos and videos

Photos and videos may be taken during the activity. By participating, the Participant agrees to be photographed or filmed and authorises the Mountain Leader to use this content for marketing and promotional purposes. If the Participant does not agree, they must inform the Mountain Leader before the activity. Otherwise, consent is assumed.

Jurisdiction

Swiss law applies exclusively.
