Terms and conditions

Marmotzet, Adilia Faivre (the “Mountain Guide”) offers organized and guided outdoor activities for any interested individual (the “Participant”). The following general conditions form an integral part of the contract between the Mountain Guide and the Participant.

Registration

The contractual basis is the written or oral registration of the Participant, carried out on the website, by e-mail or by telephone. The following general conditions are therefore applied. By registering, the Participant declares to have read, understood and accepted these general conditions.

The Participant's registration is considered complete once payment has been received. The Mountain Guide must validate the Participant's registration and reserves the right to cancel the Participant's registration at any time before the start of the activity, without having to give reasons.

Prices and payment terms

The rates recommended by ASAM-SWL are 500 CHF for one day and 380 CHF for less than 4 hours. The Mountain Guide reserves the right to apply different rates on the basis of this recommendation, in particular depending on the services, the size or the composition of the group of Participants.

The price includes the organization and supervision of the Mountain Guide during the activity.

Unless otherwise stated, the rate does not include accommodation, transportation, meals, beverages, personal expenses or equipment (including snowshoes, avalanche safety equipment).

The balance must be paid at the time of Participant registration. Payments can be made by bank transfer or TWINT. Cash payments are not accepted.

Terms of cancelation

If the Participant cancels his or her registration for an activity organized by the Mountain Guide, the cancellation conditions apply individually provided that they are specified. If not specified, the following conditions apply:

Cancellation up to 7 days before the activity: 0% of the balance is due to the Mountain Guide.

Cancellation from 7 days before the activity: 50% of the balance is due to the Mountain Guide.

Cancellation from 2 days before the activity: 100% of the balance is due to the Mountain Guide.

The Participant is aware that outdoor activities depend on uncontrollable external factors such as weather conditions and nature. The Mountain Guide reserves the right to modify the itinerary before or during the activity, as well as to cancel the activity for reasons of health, safety or comfort. The price of the event remains unchanged in the event of a change to the itinerary.

In the event of cancellation by the Mountain Guide, the Participant will be offered an alternative or a full refund.

Liability and insurance

Organization and supervision are provided by the Mountain Guide who has the necessary qualifications for the role (recognized training) and is covered by professional liability insurance.

The Participant must be in good health and in good physical condition to register and participate in an activity. In the event of major health problems (diabetes, epilepsy, heart problems, allergies, asthma, etc.) or fears likely to interfere with the progress of the activity (vertigo, etc.), the Participant must inform the Mountain guide at the time of registration. It is the Participant's responsibility to bring their own medication if they need it during the activity. All medical information remains strictly confidential between the Mountain Guide and the Participant.

The Participant is aware of the risks inherent in outdoor activities in nature and in the mountains, regardless of rigorous planning and supervision. The Participant assumes full responsibility for any theft, loss or other material damage, as well as any injury, accident, death or damage suffered or caused to others, occurring during the activity organized by the Mountain Guide.

The Participant is responsible for bringing appropriate equipment for the activity. The Mountain Guide reserves the right to refuse participation if the Participant does not have the necessary equipment for the activity.

Therefore, the Participant is responsible for his own health, accident and repatriation insurance, including mountain rescue (helicopter rescue), which may also be valid in the destination country. The Participant is also responsible for his/her civil liability insurance, including mountain accidents. Cancellation insurance is also strongly recommended.

Use of images/videos

The Participant is aware that photos and videos may be taken by the Mountain Leader and other Participants during the activity. By taking part in the activity, the Participant agrees to be photographed or filmed and gives his consent to the Mountain Guide for the use of these media for marketing and promotional purposes. If the Participant does not accept the use of these media, he or she must inform the Mountain Guide at the time of registration or before the activity. In the absence of prior notification from the Participant, the Mountain Guide reserves the right to use these media for marketing and promotional purposes.

Jurisdiction

Swiss law applies exclusively.
